O empregado integra o grupo de risco da doen\u00e7a por ter mais de 60 anos, ser hipertenso e possuir arritmia card\u00edaca.<\/p>\n\n\n\n<p>O hospital recorreu da senten\u00e7a (decis\u00e3o de 1\u00ba grau) proferida pela 76\u00aa VT\/SP alegando ter transferido o reclamante para local e hor\u00e1rio em que h\u00e1 menor possibilidade de cont\u00e1gio, mas ressaltou que atualmente nenhuma atividade \u00e9 livre de risco. A realoca\u00e7\u00e3o feita foi para o pronto-socorro do Instituto do Cora\u00e7\u00e3o (Incor), no per\u00edodo noturno, onde haveria triagem pr\u00e9via dos atendimentos \u2013 segundo o empregador, os pacientes com covid-19 s\u00e3o tratados no Instituto Central.<\/p>\n\n\n\n<p>Documentos juntados ao processo, por\u00e9m, demonstraram que o n\u00famero de profissionais do HC atingidos pela covid-19 \u00e9 muito semelhante nos dois ambientes de trabalho: 246 ocorreram no Instituto Central (28,8%) e 236 no Incor (27,6%), &#8220;a evidenciar que o risco de cont\u00e1gio \u00e9 equivalente nesses locais e que as medidas de prote\u00e7\u00e3o adotadas n\u00e3o t\u00eam se mostrado eficazes&#8221;, destacou trecho do ac\u00f3rd\u00e3o (decis\u00e3o de 2\u00ba grau), de relatoria da desembargadora Rosana de Almeida Buono.<\/p>\n\n\n\n<p>O colegiado manteve, dessa forma, a determina\u00e7\u00e3o do juiz do trabalho titular H\u00e9lcio Luiz Adorno Junior para que o reclamante exercesse suas fun\u00e7\u00f5es na enfermaria do Ambulat\u00f3rio Geral Did\u00e1tico (AGD), vinculada \u00e0 cl\u00ednica m\u00e9dica, que atende no Instituto de Ortopedia e Traumatologia (IOT).
