Para colegiado, a cl\u00e1usula, que resultaria numa jornada de 24 horas, \u00e9 incompat\u00edvel com normas constitucionais de garantia da sa\u00fade e seguran\u00e7a no trabalho.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Virada<\/h4>\n\n\n\n<p>O Tribunal Regional do Trabalho da 8\u00aa Regi\u00e3o (PA\/AP) homologou o acordo coletivo de 2017\/2018 firmado entre a Unimed de Bel\u00e9m Cooperativa de Trabalho M\u00e9dico e o Sindicato dos Profissionais de Enfermagem, T\u00e9cnico Duchista, Massagista, Empregados em Hospitais e Casa de Sa\u00fade do Estado do Par\u00e1 (Sinthosp), \u00e0 exce\u00e7\u00e3o da cl\u00e1usula relativa \u00e0 &#8220;virada de plant\u00e3o&#8221;, em caso de necessidade.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Comum acordo<\/h4>\n\n\n\n<p>No recurso ao TST, a Unimed sustentou que a norma busca garantir a regular presta\u00e7\u00e3o dos servi\u00e7os de sa\u00fade e s\u00f3 seria aplicada em casos excepcionais, em comum acordo entre empregados e chefia, com o pagamento de horas extras ou compensa\u00e7\u00e3o. Argumentou, ainda, que a Constitui\u00e7\u00e3o Federal autoriza a negocia\u00e7\u00e3o coletiva sobre hor\u00e1rios e dura\u00e7\u00e3o do trabalho.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Autoriza\u00e7\u00e3o gen\u00e9rica<\/h4>\n\n\n\n<p>Mas, segundo a relatora, ministra Maria Cristina Peduzzi, a cl\u00e1usula que autoriza genericamente a prorroga\u00e7\u00e3o de jornada de 12 horas para mais 12 horas de trabalho, para cobrir escala de servi\u00e7o que deve ser organizada pelo empregador, contraria a garantia da sa\u00fade e da seguran\u00e7a no trabalho prevista na&nbsp;<a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/constituicao\/constituicao.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Constitui\u00e7\u00e3o Federal<\/a>, na&nbsp;<a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/decreto-lei\/del5452.htm\" target=\"_blank\" rel=\"noreferrer noopener\">CLT<\/a>&nbsp;e na&nbsp;<a href=\"https:\/\/www.ilo.org\/brasilia\/convencoes\/WCMS_236163\/lang--pt\/index.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Conven\u00e7\u00e3o 155<\/a>&nbsp;da Organiza\u00e7\u00e3o Internacional do Trabalho (OIT), ratificada pelo Brasil.<\/p>\n\n\n\n<p>Na avalia\u00e7\u00e3o da ministra, considerando a din\u00e2mica das atividades do setor, a falta de profissional da sa\u00fade em plant\u00e3o de 12 horas n\u00e3o pode ser suprida com a coloca\u00e7\u00e3o de outro em situa\u00e7\u00e3o de risco \u00e0 sua sa\u00fade e \u00e0 sua seguran\u00e7a.<\/p>\n\n\n\n<p>A decis\u00e3o
